Warwick, RI – The owners of a Warwick pain management clinic, Alternative Integrative Medicine, LLC (doing business as AIM Health), have been indicted on federal charges of health care fraud. Brandon Nowak, 32, and Jason Simmons, 33, both of Foster, Rhode Island, were indicted by a federal grand jury on one count of conspiracy to commit health care fraud and 14 counts of health care fraud, the U.S. Attorney’s Office for the District of Rhode Island announced on Monday.
According to court documents, Nowak and Simmons began submitting fraudulent claims to Medicare, Medicaid, and private insurers in October 2020. These claims were for services that were either not provided or not delivered by qualified professionals. The services in question included acupuncture, infrared therapy, hot and cold therapy, therapeutic activities, and home management training.
Additionally, the defendants misrepresented massage therapy sessions—services typically not covered by insurance—as reimbursable treatments such as physical therapy or office visits. The fraudulent scheme allegedly continued until December 2023, targeting Medicare Advantage, Medicaid Managed Care, and four commercial insurers.
If convicted, Nowak and Simmons each face up to 10 years in prison and a $250,000 fine for each count. The indictment also includes a forfeiture provision, seeking a money judgment of at least $273,370.09 and any property traceable to the fraud. If the property cannot be located, substitute property may be forfeited.
Nowak and Simmons are scheduled to be arraigned on April 11 in U.S. District Court.
