A Bolivar business owner is being sued by Missouri Attorney General Catherine L. Hanaway for alleged violations of the Missouri Merchandising Practices Act. According to court filings, Hanaway’s office has filed a lawsuit against Premier DirtWorks and Concrete, LLC, and its owner Kenneth Eugene Nutter, claiming they deceived customers by taking payments for construction work that was never completed.
The petition, filed on Oct. 14 in Polk County Circuit Court, seeks an injunction, restitution for affected customers, civil penalties, and other relief. It alleges that from June 2024 through January 2025, Premier DirtWorks and Nutter advertised and sold excavation and concrete services but failed to complete the projects after receiving large upfront deposits.
Prosecutors say several customers paid tens of thousands of dollars for shop buildings that were never started and did not receive refunds. Court documents show that Nutter organized the company in February 2021 and operated from 1961 E. Buffalo Street in Bolivar.
Hanaway’s office contends that Nutter and his company engaged in deception, false promises, and unfair practices, violating Missouri consumer protection laws. In one instance, a customer paid a $24,320 deposit in December 2023 for a shop building project that was supposed to start by February 2024, but no construction took place and no refund was issued. Another customer allegedly paid $26,484 in September 2023 for a project that was never started.
The Attorney General’s petition asks the court to permanently prohibit Nutter and Premier DirtWorks from advertising, soliciting, or performing residential construction work in Missouri.
When contacted for comment, Nutter told Ozarks First that personal circumstances affected his ability to complete projects, adding that one case has been resolved and he expects to settle the other by the end of the week.
