WINDSOR, N.Y. — A Tioga County man has been convicted following a jury trial related to theft incidents that occurred over several months in 2023 and 2024, according to the Broome County District Attorney’s Office.
Timothy E. Hoose Sr., 51, of Berkshire, was found guilty on December 17 of grand larceny in the third degree. The conviction stems from an incident between September 2023 and January 2024 in the Town of Windsor.
Prosecutors said Hoose was operating as H&H Contracting when he entered into a contract with a homeowner to construct a garage. The victim provided a $15,000 down payment for the project. Evidence presented at trial showed Hoose unlawfully converted $3,000 of those funds for purposes unrelated to the construction.
Under New York State Lien Law, contractors are required to hold client deposits in trust and use the funds solely for the contracted project. Authorities said Hoose failed to properly account for the money and did not provide the victim with a required written accounting despite a formal request.
“Contractors who abuse their position of trust and misuse client funds will be prosecuted,” said Broome County District Attorney F. Paul Battisti, noting that the state’s Lien Law is designed to protect homeowners from financial misconduct.
Hoose is scheduled to be sentenced on March 18, 2026, and faces up to seven years in state prison.
