Sharath S Convicted in Bellare House Theft Case

Absconding accused jailed after arrest by police

The Bellare Police have arrested a man who had been absconding and repeatedly failing to appear before the court in connection with a house theft case. After his arrest, the accused was produced before the court, which later sentenced him to imprisonment and imposed fines under multiple legal provisions.

The accused has been identified as Sharath S (24), a resident of Neriya in Beltangady taluk of Dakshina Kannada district.

According to police sources, Sharath had been accused in a house theft case but repeatedly failed to attend court hearings. As a result, authorities treated him as absconding. Acting on this, Bellare police traced and arrested him before producing him before the court for further proceedings.

After examining the evidence, the court found the accused guilty and delivered its judgment under relevant legal provisions.

Under Indian Penal Code Section 457 (lurking house trespass or house-breaking by night), the court sentenced him to six months’ simple imprisonment and imposed a Rs500 fine.

Under Indian Penal Code Section 380 (theft in a dwelling house), he was sentenced to 10 months’ simple imprisonment along with another Rs500 fine.

The court also ordered that failure to pay the fines would result in an additional 10 days of imprisonment.

Apart from the theft charges, the accused also faced legal action for not appearing before the court during earlier hearings. Since he ignored court summons and remained absconding, a separate case was registered against him under Bharatiya Nyaya Sanhita Section 269.

For this offence, the court imposed a Rs1,000 penalty, with an additional 10 days of imprisonment if the fine is not paid.

Investigation and Prosecution

The investigation in the theft case was carried out by Santosh B P, Sub-Inspector, who collected evidence and completed the procedural requirements before submitting the final report to the court.

During the trial, Preethi M C, Assistant Public Prosecutor, represented the prosecution and presented arguments that led to the conviction.

Police officials said the arrest and conviction demonstrate the commitment of law enforcement agencies to track down accused persons who attempt to evade legal proceedings and ensure compliance with court orders.
