A Wilton woman has been arrested after authorities say she and her husband accepted an offer on their property and then secured a second mortgage on the same home days later.
According to a criminal complaint filed in Scott County Court, Michelle Driver, 52, and her husband, Joshua Driver, accepted a written offer on July 3 and 4 of last year for property they owned on Meadow Lane in Walcott.
On July 10, the couple allegedly signed documents to obtain a second mortgage on the property totaling $49,885.59. The mortgage transaction was later recorded by the Scott County Recorder’s Office on July 23, 2025.
The following day, July 24, 2025, Michelle and Joshua Driver signed a composite mortgage affidavit stating they had not taken out any mortgages, lines of credit or bridge loans on the Meadow Lane property within the previous 90 days. The affidavit was notarized by a notary public.
Investigators allege the Drivers knowingly filed the false affidavit and accepted the loan funds with the intent to deprive the lender of the money.
A warrant was issued for Michelle Driver’s arrest on Feb. 9. She was taken into custody Feb. 10 and charged with first-degree fraudulent practices and first-degree theft. Court records show she was released on a $10,000 cash-only bond and is awaiting her next court appearance.
Joshua Driver has not been taken into custody.
