IDAHO FALLS — Marcus Delbert Smith, 48, of West Magic, was arrested on June 26 during a traffic stop after deputies discovered an active warrant for his arrest related to an involuntary manslaughter case from early 2024. Smith now faces an additional felony charge for possession of a controlled substance.
The charges stem from the April 14, 2024, death of Joshua James Perotto, who was found unresponsive at his home and later died at Eastern Idaho Regional Medical Center. Despite efforts by Perotto’s girlfriend to revive him using Narcan, he passed away. A toxicology report later revealed mixed drug intoxication involving fentanyl and methamphetamine as the cause of death.
Deputies obtained a search warrant for Perotto’s phone and uncovered text messages between Perotto and Smith discussing illegal narcotics. Attempts to locate Smith were initially unsuccessful, leading to the issuance of an arrest warrant.
Smith was stopped by deputies on Woodruff Avenue for a trailer with faulty tail lights. Upon identifying him, deputies arrested Smith and found fentanyl in his possession. He was booked into Bonneville County Jail.
Smith’s preliminary hearing is scheduled for July 9 before Magistrate Judge John Dewey. He faces up to 17 years in prison and fines totaling $30,000 if convicted. He is presumed innocent until proven guilty.
