Kathleen Penner Ordered to Pay Over $240K in Elderly Abuse Case

Court Ruling Over Misappropriated Funds from Donna Manning's Estate

A Manitoba family is still seeking justice after more than a decade of legal battles. Despite winning a 2023 court judgment, they claim that over $170,000 of their elderly aunt’s money was misappropriated by someone they once considered a friend.

Kathleen Penner, 70, was found guilty of exploiting her position as both the power of attorney and the executor of Donna Manning’s estate. The family says Penner used the senior’s funds to pay for things like plane tickets, jewelry, and vacations, as revealed in court documents.

“It’s shocking to think that someone could take advantage of an elderly woman like this,” said Glenda Manning, Donna’s niece. Glenda explains that Penner spent over $170,000 before and after Donna’s death in 2015, using her trust to misappropriate the money.

In 2023, the Manitoba Court of King’s Bench ruled in favor of the Manning family, ordering Penner to repay the stolen funds with interest and punitive damages. However, the family is still struggling to enforce the judgment.

They’re speaking out to raise awareness about elder abuse and encourage others to monitor the welfare of vulnerable seniors. “Elderly people need better protection from being taken advantage of,” Glenda said.

Penner, who works in the funeral industry, declined an interview request in October, citing plans to hire a lawyer. She did not respond to follow-up inquiries.

In a 2021 affidavit, Penner defended her actions, stating that she had a close relationship with Donna and claimed that any funds she spent were gifts from her late friend.

The 2023 judgment held Penner accountable for both the misappropriated funds and the emotional toll on Donna’s family. The total amount Penner was ordered to pay exceeds $240,000, including interest and punitive damages.
