GASSAWAY, W.Va. (WDTV/Gray News) – A West Virginia couple has been charged with murder after their 4-month-old baby died from alcohol poisoning.
According to the Braxton County Sheriff’s Department, James Joseph Smith, 34, and Angel Talbert, 23, of Gassaway, are facing first-degree murder, child neglect resulting in death, and conspiracy charges. The baby’s death occurred on November 16, 2024.
Court records reveal the tragedy unfolded after deputies received medical examiner results earlier this month. Tests showed the baby’s liver contained a lethal ethanol level of .321, which a doctor confirmed would be fatal to an infant.
Further investigation revealed that Smith and Talbert had been rubbing alcohol on the baby’s gums daily for about a month, attempting to soothe her when she was fussy. Smith admitted the practice during a follow-up interview after the test results came back.
According to initial reports, the couple discovered the baby face down and unresponsive between 4 and 5 a.m. Talbert called 911 while Smith attempted CPR. They drove toward the hospital but met an ambulance en route. Despite emergency care, the infant was pronounced dead at 5:32 a.m..
Deputies inspecting the home found roach infestations, no running water, and THC smoking devices. Smith explained they used a spigot in the back room to fill containers for bathroom and kitchen use.
Both Smith and Talbert are currently held at Central Regional Jail without bond as the investigation continues.
