BOYNTON BEACH, FL – The owner of a Boynton Beach restaurant is facing serious felony charges after allegedly failing to remit tens of thousands of dollars in collected sales tax.
Kenson Fevrier, 41, was arrested and charged with theft of state funds through the non-remittance of sales tax, a second-degree felony, according to the Florida Department of Revenue.
Fevrier, who owns Ney Caribbean Restaurant LLC located at 10114 S Military Trail, reportedly collected $38,337.47 in sales tax from customers between May 2020 and November 2024. However, state investigators say he only submitted $339.51 of those funds to the state treasury.
Despite repeated attempts to contact Fevrier, including field visits and written notices, the business failed to file required monthly sales tax returns. Subpoenaed financial records from payment processor Fiserv and banks including Citibank and Bank of America confirmed the restaurant had sufficient funds to pay the taxes but knowingly withheld them.
Officials say the evidence supports a conclusion that Fevrier intentionally avoided remitting state funds. He was booked into the Palm Beach County Jail and faces prosecution under Florida’s tax code.
