WHEATON, Ill. — Three 18-year-old men from the northwest suburbs are awaiting trial after being charged with sexually assaulting a female classmate at a private graduation party in Roselle.
Kevin Niemiec, Zachary Mascolo, and Jon Clary II appeared in First Appearance Court this week. Niemiec, charged with three counts of criminal sexual assault, was denied pre-trial release by Judge Joshua Dieden. Clary, charged with three counts, and Mascolo, charged with two counts, were granted pre-trial release with conditions barring alcohol use and contact with the victim or her family.
A warrant for the three men’s arrest was issued on Dec. 17. Mascolo was taken into custody near his home four days later, while Clary and Niemiec surrendered the following day at the DuPage County Jail.
The Roselle Police Department (RPD) said the alleged assault occurred between June 14 and June 15, 2025, during a private party off-campus. According to investigators, the victim was assaulted in a minivan by all three men. The victim later went to a friend’s home and contacted her family, who took her for medical attention.
DuPage County State’s Attorney Robert Berlin called the allegations “extremely serious” and praised the victim for her courage in reporting the incident.
Saint Viator High School Principal Dr. Erika Mickelburgh emphasized that the incident occurred at a private, non-school-sanctioned event after the students had graduated. The school affirmed its commitment to student safety and stated it will cooperate with law enforcement while refraining from further comment due to ongoing legal proceedings.
RPD Chief Rob Barreto commended detectives for their extensive investigative work following the incident.
Upcoming court dates are Jan. 12, 2026, for Niemiec and Jan. 27, 2026, for Mascolo and Clary.
