ALBUQUERQUE, N.M. – Deomtray Davis has been charged with murder and evidence tampering after allegedly firing a gunshot that killed a bystander during a fight involving two homeless men in Albuquerque.
The incident occurred on April 4 near Central Avenue SE and Cochiti Road. According to the Albuquerque Police Department (APD), Davis was sitting nearby and knew one of the men involved in the fight. That individual falsely claimed to Davis that he had been stabbed by the other man, identified as Jonathan Bouldin.
In response, Davis allegedly opened fire. The bullet struck Bouldin in the arm and then fatally hit 39-year-old Brian Miller, a bystander, in the head. Miller died at the scene.
Surveillance footage captured Davis fleeing the scene. Investigators later recovered the firearm he allegedly used, which had been discarded in a trash can in a nearby parking lot.
Davis was initially arrested on unrelated charges on April 9. He was later re-arrested on a warrant for the shooting and booked into the Metropolitan Detention Center.
