A former dentist, Bozena Rak-Latos, 63, and her children have been found guilty of orchestrating a £350,000 dental insurance fraud through their North London clinic but were spared immediate jail terms.
Rak-Latos, struck off by the General Dental Council in 2018 following a prior fraud conviction in Poland, masterminded the scheme with the help of her son, Kacper Latos, 36, and daughter, Magdalena Latos, 33.
The fraud was executed via BRL Dentos Ltd, trading as Diamond Dental & Medical Clinic in Finchley, London. From August 2020 to June 2021, the clinic submitted £356,587 in claims to Simply Health, of which £141,618 was paid out. The claims were linked to 113 insurance policies across seven companies, with patients falsely listed as employees to qualify for corporate dental insurance.
Despite being barred from practice, Bozena controlled the clinic and directed the fraud. Evidence showed her instructing her children on submitting claims, responding to insurers, and concealing the scheme. When authorities contacted patients, she ordered clinic computers replaced and instructed her children to ensure claimed treatments appeared completed.
Kacper Latos exploited insurance schemes immediately after registering with the General Dental Council in June 2020, submitting inflated or fake claims for himself, his parents, and other purported employees, some of which were paid into his personal account. He also enrolled patients into the schemes and falsified bank statements.
Magdalena Latos, managing reception and marketing, expanded the fraud, opening a business account for London Smile Design to collect payments and liaising with insurance brokers to add members and pursue claims. Evidence linked her to multiple companies despite her denials.
Financial records revealed £80,000 was sent to Poland to repay Bozena’s debts. HMRC records showed minimal declared income and no taxes paid during the fraud period, despite COVID-19 grants received by the clinic.
IFED officers executed search warrants at three London properties, seizing 22 digital devices and a safe containing £33,523.93 in cash from Bozena’s bedroom.
Following a four-week trial at Wood Green Crown Court, all three defendants were convicted. Bozena Rak-Latos received a two-year prison sentence, suspended for two years, and 180 hours of unpaid work. Kacper Latos received 20 months suspended for two years and 90 hours unpaid work, while Magdalena Latos received 18 months suspended for two years and 150 hours unpaid work.
Trainee Detective Sergeant Alan Yau from IFED stated, “This was a calculated fraud, orchestrated by a former dentist using her knowledge and influence to manipulate her children. Bozena was the driving force, directing the operation and attempting to cover her tracks. This sentencing reflects the seriousness of the crime and IFED’s commitment to pursuing complex insurance fraud.”
