Owner of Buenos Dias Adult Daycare Arrested for Medicaid Fraud

Houston, TX – Rosalinda Bennett, 78, owner of Buenos Dias Adult Daycare, was arrested on January 31, 2025, on charges of health care fraud after allegedly billing the Texas Medicaid Program more than $168,000 for services that were never rendered.

The investigation dates back to February 12, 2019, when an anonymous tip raised concerns about fraudulent billing practices at the daycare. The tipster claimed that clients were being used to assist other clients off transportation vans, leading to unsafe situations for individuals, including one client with epilepsy who reportedly fell while exiting the vehicle.

Further investigation revealed that one Medicaid recipient had not attended the daycare from June to December 2018, yet their account was billed through October 2018. Authorities also found discrepancies in the daycare’s transportation records, where clients who were absent were still marked present, and falsified pickup and drop-off times were documented.

Bennett was interviewed in September 2023 and denied the allegations, claiming that former employees were behind the accusations. However, former daycare staff members admitted that they falsified attendance and transportation times as instructed by higher-ups, including the daycare’s director.

Between January 2020 and April 2022, Buenos Dias Adult Daycare submitted fraudulent claims for services that were never provided. The investigation determined that the daycare fraudulently billed Texas Medicaid a total of $168,065.54.

Bennett was charged with health care fraud, a second-degree felony, and was released after bonding out the same day. The case is ongoing as investigators continue to look into the fraudulent activities at the daycare.
