ICE Arrests Jose Garcia-Salmeron, Salvadoran National Charged with Rape

BOSTON — U.S. Immigration and Customs Enforcement (ICE) has apprehended Jose Garcia-Salmeron, a Salvadoran national charged with raping a Massachusetts resident, following his arrest on January 22 in Boston.

“Jose Garcia-Salmeron is charged with victimizing one of our Massachusetts residents and represents a significant threat to the safety of Massachusetts neighborhoods,” said ICE Enforcement and Removal Operations (ERO) Boston acting Field Office Director Patricia H. Hyde. “We will not tolerate such threats to our neighbors. ERO Boston will continue to prioritize public safety by targeting, arresting, and removing any illegally present individuals who present such a threat to our New England communities.”

Garcia, 34, was initially arrested by U.S. Border Patrol agents on July 16, 2007, after he illegally entered the U.S. He was issued a notice to appear before an immigration judge but was later transferred to the Office of Refugee Resettlement, which released him from custody on August 31, 2007. An immigration judge ordered his removal from the U.S. to El Salvador in November 2007.

Garcia was encountered by ERO Boston on July 2, 2024, following an arrest by the Revere Police Department in Massachusetts. An immigration detainer was issued, and he was placed in custody at the Nashua Street Jail in Boston. The Chelsea District Court arraigned Garcia on a rape charge, which was subsequently indicted to Suffolk Superior Court in Boston.

However, despite the immigration detainer, the Chelsea District Court released Garcia from custody on July 26, 2024.

Garcia now remains in ERO custody, where he faces both rape charges and immigration violations. ICE is continuing its efforts to ensure public safety in the New England region.
