Dr. Kamal Kabakibou Settles for $3.5M Over Fraud Allegations

Kabakibou and The Center for Pain Management to Pay for Fraudulent Billing

ATLANTA, GA – Dr. Kamal Kabakibou and his medical practice, The Center for Pain Management, have agreed to pay $3.5 million to resolve allegations of violating the False Claims Act and the Controlled Substances Act, according to the U.S. Attorney’s Office for the Northern District of Georgia.

The settlement addresses claims that Kabakibou’s practice billed for unnecessary medical tests and improperly pre-signed opioid prescriptions, which were then dispensed by nurse practitioners while he was out of the country. These actions resulted in fraudulent billing to federal health insurance programs, including Medicare, TRICARE, and the Department of Labor.

“Our office will continue to insist that dangerous opioids be properly dispensed and that federal healthcare dollars be wisely spent,” said Acting U.S. Attorney Richard S. Moultrie, Jr. “We will work vigorously with our federal agencies and law enforcement partners to hold accountable those who engage in misconduct.”

The U.S. Attorney’s Office claims Kabakibou, who runs pain-management clinics in Atlanta and Blue Ridge, Georgia, conducted unnecessary and duplicative urine drug tests, which were improperly billed to federal programs. Furthermore, Kabakibou allegedly pre-signed prescriptions for Schedule II controlled substances, allowing nurse practitioners to dispense these medications unsupervised.

“HHS-OIG remains committed to collaborating with our law enforcement partners to hold accountable those who engage in fraud schemes that exploit federal healthcare programs and jeopardize patient safety,” said Kelly J. Blackmon, Special Agent in Charge of the HHS Office of Inspector General (HHS-OIG).

The claims settled in this case are allegations, and no determination of liability has been made.
