Former New Mexico State Police Lieutenant Arrested for Fraud Charges

El Paso, TX (KTSM) – David Neil, a former lieutenant with the New Mexico State Police (NMSP), was arrested on Tuesday, July 23, on allegations of timecard and overtime fraud, the department announced. Neil, 55, turned himself in and was booked into the Grant County Detention Center, facing one count of fraud and 55 counts related to receiving public money for services not rendered, as well as making or permitting false public vouchers.

The arrest follows an extensive investigation that began after internal audits revealed discrepancies in Neil’s timecard submissions and overtime claims. The NMSP said that this arrest marks a significant step in their ongoing efforts to maintain transparency and uphold integrity within the department.

Neil, a resident of Gila, New Mexico, worked for NMSP for over 24 years. His duties included law enforcement in and around Silver City, located about 30 miles from his home. However, the investigation, conducted in collaboration with the Sixth District Attorney’s Office, uncovered substantial evidence that Neil had falsified records, claiming overtime for hours he had not worked.

In response to these findings, NMSP Chief Troy Weisler emphasized the department’s commitment to accountability and ethical standards. “Today is a difficult day for the New Mexico State Police,” Weisler said in a press release. “However, it underscores our unwavering dedication to transparency and ethical conduct. No one is above the law, and we will continue to hold ourselves to the highest standards of accountability. The actions of this individual do not reflect the values and integrity of our officers who serve their communities with honor every day.”

The internal investigation was launched in December 2023 when the severity of the allegations came to light. Neil was placed on administrative leave on December 7, 2023. Although he was eligible for retirement, Neil submitted his retirement paperwork on January 1, 2024, shortly after the investigation began.

Despite Neil’s retirement, NMSP officials made it clear that the investigation into his conduct is ongoing. The department is working closely with the Sixth District Attorney’s Office to ensure that all aspects of the case are thoroughly examined.

The arrest of a high-ranking officer like Neil highlights the challenges law enforcement agencies face in maintaining public trust and internal discipline. For NMSP, the decision to arrest one of its own demonstrates their commitment to addressing misconduct and reinforcing the importance of accountability within the department.

Neil’s arrest and the charges he faces signal a clear message: no matter one’s rank or tenure, unethical conduct will not be tolerated.
